Terms of Service

These terms cover your agency's use of Delegyn Shift. By creating an account you agree to them on behalf of your organisation.
Delegyn Shift is operated by BrightBench LLC, a Nebraska limited liability company. “We”, “us” and “our” mean BrightBench LLC; “you” means the organisation subscribing to the service.
What the service is
Delegyn Shift is workforce scheduling software: locations, positions, a staff roster, shifts, assignments, time off, attendance records, printable schedules, and a staff-facing view of their own shifts.
It is a scheduling tool and nothing more. It is not a payroll system, not an electronic health record, not a compliance or credential-tracking system, and not a substitute for your own judgement about staffing.
What you agree not to put into it
Do not enter information about the people your agency supports. No names of individuals served, no diagnoses, no support or behaviour plans, no incident reports, no service notes. There is no field for any of this, and free-text fields such as shift notes must not be used for it either.
This matters to you as much as to us. Delegyn Shift is not built, and is not offered, as a system for protected health information. Putting that information in — including in a note field — takes it outside what this product is designed to hold and outside what these terms cover.
You also agree not to:
- Use the service unlawfully, or to store Social Security numbers or banking details.
- Share a login between people. Each person who needs access gets their own.
- Attempt to reach another agency's data, probe or attack the service, or work around its access controls.
- Resell or rebrand the service without a written agreement with us.
Accounts and responsibility
You are responsible for who you invite, what role you give them, and for removing access when someone leaves. Roles are how access is controlled, so giving someone Administrator gives them everything for your agency.
You confirm you have the right to enter your staff members' information and to tell them it is held here. Our Privacy Policy describes what that means in practice, and you are welcome to share it with them.
Your data is yours
Your schedules, roster and records remain your agency's. We use them only to run and support the service. You can ask for an export at any time, and we will provide one on request. If you leave, ask for your export before closing the account.
What it costs
- $20 per month per agency, plus $1 per month per staff member.
- The staff figure is the highest number active at any point during the billing month, not the number on the last day. Somebody who worked three weeks and was then archived is counted for that month.
- Optional add-ons are priced separately and shown to you before they are enabled. No add-on is switched on without your agreement.
- A 14-day free trial, with no card required. When a trial ends the account becomes read-only and shows the next few days of shifts so nobody is left without a schedule, and we will contact you rather than simply locking you out.
- Prices may change with at least 30 days' notice, and never mid-way through a period you have already paid for.
What we promise, and what we do not
We will run this service carefully and fix things promptly. We do not currently offer a guaranteed uptime commitment, and we would rather say that plainly than publish a number we cannot stand behind. If that is a requirement for your agency, talk to us before subscribing.
The service is provided as is. To the extent the law allows, we disclaim implied warranties of merchantability and fitness for a particular purpose.
Staffing decisions are yours
Delegyn Shift will warn you about overtime and will refuse a scheduling conflict, and those features are there to help. They are not a compliance guarantee. You remain responsible for wage and hour law, overtime rules, break requirements, staffing ratios, licensing obligations, and whether the person you scheduled actually holds the credential the shift requires.

Limitation of liability
To the extent the law allows, neither party is liable to the other for indirect, incidental or consequential damages, or for lost profits. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim arose.
Ending it
You can cancel at any time, effective at the end of your current billing month. We can suspend or end an account that breaches these terms — and other than for serious misuse we will tell you what the problem is and give you a reasonable chance to fix it first.
If we ever discontinue the service we will give you reasonable notice and an export of your data.
Governing law
These terms are governed by the laws of the State of Nebraska, without regard to its conflict-of-laws rules. Any dispute arising out of them or out of your use of the service will be brought in the state or federal courts located in Nebraska, and both of us consent to the jurisdiction of those courts.
If any part of these terms is held unenforceable, the rest continues to apply.
Changes to these terms
We may update these terms. For any change that materially affects you we will tell subscribing agencies directly rather than relying on you to spot the new date.
